Preamble
SAS Maison Vacquerie is a limited liability company (single shareholder company) registered with the Paris RCS under number 983 405 135 and whose head office is 13 rue Quantin Bauchart - share capital: 1,000.00 euros. Intracommunity VAT number: FR90983405135
Maison Iéna operates the Maison Iéna hotel establishment located 22 rue Vacquerie, 75116 Paris Paris (hereinafter “the accommodation”) as well as the website “www.maisoniena.com” (hereinafter “the Site”) which allows to make a reservation at the Hotel and which provides information on the services of Maison Iéna.
These General Conditions of Sale (hereinafter “CGV”) apply to any person wishing to make a reservation for room(s) and any additional services at the Hotel (hereinafter “Customer”), in addition to the Conditions General Conditions of Use of the Site (hereinafter “CGU”), accessible at the footer of the Site, which govern the use of the Site more generally.
The T&Cs and CGU alone govern the relations between Maison Iéna and the Client, in addition to the indications appearing elsewhere within the Hotel.
Maison Iéna and the Client are together hereinafter referred to as “the Parties”.

ARTICLE 1 – RESERVATION CONDITIONS
1.1 – PREREQUISITES
To make a reservation, the Customer must be of legal age and not be incapable of entering into a contract.
Any reservation made with Maison Iéna implies acceptance without restriction or reservation of all of these General Terms and Conditions by the Customer who acknowledges having taken the time to examine them, have perfect knowledge of them and appreciate their meaning and scope.
1.2 – SPECIAL RULES APPLICABLE TO THE HOTEL
Check-in time
Reserved rooms are available from 3:00 p.m.
Departure time
On the day of departure, rooms must be vacated no later than 12:00 p.m. except in the event of late departure (Late Check Out), a service which may be offered on site at the Hotel depending on the occupancy rate.
Number of occupants
At the time of booking, the Customer must specify the number of people who will occupy the reserved room(s), specifying the number of children if applicable.
If there are young children, the Hotel offers the rental of a baby bed per room per night. The Customer must make this choice at the time of booking.
If the number of people arriving at the Hotel does not correspond to the number of people mentioned when booking, the Hotel may charge an upgrade (larger room or addition of additional room(s)) or cancel the reservation if the occupancy rate does not allow an upgrade in which case the cancellation conditions of article 5 will be applied to the Customer.
On-site verification
Minors or incapable adults must be accompanied by a legal guardian.
The Hotel reserves the right to request the presentation of proof of identity (in particular) in due form.
Equipment
The Hotel's rooms are all furnished with furniture and notably equipped with advanced audiovisual technologies.
The Customer undertakes to use the equipment made available to him only for the purposes for which they are intended and in accordance with the instructions provided. Any other use and in particular any unplanned/approved manipulation (such as opening, modification, movement outside the room or spaces to which this equipment is dedicated, etc.) is strictly prohibited.
All repair and/or replacement costs linked to damage during the Client's stay are the Client's responsibility.
Security deposit
A security deposit will be requested on site upon arrival at the Hotel. This security deposit will take the form of either a pre-authorization made on the credit card provided on arrival (no debit will be made) or a remittance of an amount in cash (no collection will be made) and will be used in the event of damage observed, without prejudice to all other rights and remedies. The security deposit will be returned to the Customer at the end of their stay if no damage is noted.
Wifi access
The Hotel provides its Guests with free WiFi access.
The Customer is solely responsible for his use of the internet network and undertakes not to use the access made available to him by Maison Iéna to commit acts contrary to laws and regulations, public order, or good morals, or constituting violations of the rights of others of any nature whatsoever.
Animals
Only small pets are allowed in the hotel.
No Smoking
Smoking is strictly prohibited in the Hotel.
ARTICLE 2 – MAKE A RESERVATION FROM THE SITE
For any reservation request for more than 4 rooms, please contact us via the address direction@maisoniena.com.
2.1 – BOOKING CHOICES AND PREFERENCES
To make a reservation from the Site, the Customer is invited to follow the customer journey provided for this purpose by providing:
- Their desired arrival and departure dates.
- A category of room: the Site specifies the characteristics of each room and reservation formula.
- The number of occupants, children included (free baby bed on request).
- Your choice from a selection of complementary services (For example: Buffet Breakfast, purchase of a bottle of champagne, arrival at 1 p.m., etc.)
- Their choice of rate between the flexible reservation rate (hereinafter “FLEXIBLE RATE”) and the non-modifiable reservation rate (hereinafter “NON-CANCELLABLE RATE”) (See description in 2.2 below).
At any time, the Customer has the possibility of going back to modify his choices, as long as he has not provided his personal data and confirmed the reservation at the Reservation Confirmation step (see 2.3 below).
2.2 – PRICES
The NON-CANCELLABLE RATE category corresponds to a lower rate in return for a guarantee policy and stricter, non-refundable cancellation conditions.
Guarantee policy: Pre-payment by credit card of the entire stay debited at the time of booking.
Cancellation and No Show: The amount incurred is not refundable, even in the event of cancellation and/or modification and/or no show at the Hotel.
The NON-CANCELLABLE RATE BREAKFAST INCLUDED category corresponds to a lower rate in return for a guarantee policy and stricter cancellation conditions and is non-refundable by having breakfast included.
Guarantee policy: Pre-payment by credit card of the entire stay debited at the time of booking.
Cancellation and No Show: The amount incurred is not refundable, even in the event of cancellation and/or modification and/or no show at the Hotel.
The FLEXIBLE RATE category corresponds to a higher rate in return for a guarantee policy and lighter cancellation conditions.
Guarantee Policy: All reservations must be guaranteed with a valid credit card.
Cancellation: Cancellation free of charge until 3:00 p.m. (Paris local time) the day before the scheduled arrival date. Beyond that, the Hotel charges the first night.
No-show: In the event of no-show at the Hotel, the first night will be billed as compensation.
PLEASE NOTE THAT BY CHOOSING THE NON-CHANGABLE RATE, THE CUSTOMER EXPRESSLY AGREES TO BE SUBJECT TO THE APPLICATION OF A GUARANTEE POLICY AND MORE STRICT CANCELLATION CONDITIONS AS DESCRIBED ABOVE, IN COUNTER OF THE BENEFIT A LOWER BOOKING RATE.
2.3 – RESERVATION CONFIRMATION AND PAYMENT
At the end of the reservation process, the Customer must provide their personal data, at least Name and email address, necessary to process their reservation (refer to article 7 below regarding the processing of Personal Data) .
The Customer must then validate his acceptance of these General Terms and Conditions (available via the link provided for this purpose).
Finally, the Customer must provide their payment information, and, in the event of choosing a NON-CANCELLABLE RATE, proceed to pre-pay the entire amount of their reservation (refer to article 4 below regarding payment) .
Once the reservation has been made via the Site, the Customer will receive an e-mail to the e-mail address provided during the reservation, confirming its consideration and including the references of the reservation with the details of the transaction carried out in the event of online prepayment.
The Client takes all precautionary measures required to keep his/her booking details secret and prevent any use by unauthorized persons or any infringement. Maison Iéna declines all responsibility in the event of loss, theft or illicit use of references, as well as in the event of errors made during the reservation.
Any resale/offer of resale, any exchange/offer of exchange, any redistribution/offer of redistribution (including free of charge and/or in particular in the context of competitions) of reservations is strictly prohibited. In the event of violation of the prohibition mentioned above, and more generally, in the event of fraud (in particular by falsification or attempted falsification) Maison Iéna reserves all rights and actions, in particular the right to claim damages.
2.4 – PROOF OF RESERVATIONS MADE ON THE SITE
Unless proven otherwise, according to the means accepted by the French courts and tribunals, it is admitted by the Parties and expressly accepted by the Customer that the data recorded by Maison Iéna during a reservation made on the Site constitutes the only proof of all reservations made by the Customer on the Site, their conditions of making and their content.
ARTICLE 3 – PRICE
3.1 - The prices appearing on the Site are indicated, and payable, in euros including VAT. All applicable taxes, in particular tourist tax, government or local taxes, will be added and will be paid by the Customer on site at the Hotel.
3.2 – The Customer is informed that the Hotel's pricing policy takes into account, in addition to the choice between FLEXIBLE RATE and NON-CANCELLABLE RATE, in particular the reservation period and the crowds.
3.3 - Maison Iéna reserves the right to modify the prices indicated on its Site at any time, it being specified that the services are invoiced on the basis of the prices in force at the time the Customer makes their reservation.
ARTICLE 4 - PAYMENT
4.1 - The accepted means of payment are specified at the time of booking. Only one payment method is authorized per reservation made online.
4.2 - Payment is made at the Hotel on the day of the Customer's arrival, unless the selected rate involves pre-payment when booking online (see details of FLEXIBLE and NON-CANCELLABLE rates in the article 2.2 above), in which case the Client's bank account will be debited after final validation by the Client and acceptance of their reservation.
4.4 - Payments on the Site are secured by the Stripe payment system using the SSL encryption protocol. This data cannot therefore be detected, intercepted or used by third parties.
Payment data is also not stored on our IT systems.

ARTICLE 5 – ABSENCE OF RIGHT OF WITHDRAWAL – CONDITIONS FOR CANCELLATION OF BOOKING
In accordance with the provisions of article L221-28-12° of the Consumer Code, the right of withdrawal (provided for in article L221-18 of the Consumer Code) cannot be exercised for service contracts. accommodation that must be provided on a specific date or period.
The cancellation conditions applicable to the Customer depend on their choice between FLEXIBLE RATE and NON-CANCELLABLE RATE at the time of booking:
- Cancellation conditions in FLEXIBLE RATE category:
Cancellation free of charge until 3:00 p.m. (Paris local time) the day before the arrival date indicated on the order summary. Beyond that, the Hotel charges the first night.
In the event of no-show at the Hotel on the arrival date indicated on the order summary, the first night will be billed as compensation.
- Cancellation conditions in NON-CANCELLABLE RATE category:
The amount incurred is not refundable, even in the event of cancellation and/or modification, and/or no-show at the Hotel.
ARTICLE 6 – INTELLECTUAL PROPERTY AND OTHER RIGHTS ATTACHED TO THE CONTENTS OF THE HOTEL AND THE SITE
The Site as well as all elements of any nature that it may contain (including texts, graphics, posters, videos, sound content, images, logos, brands, various creations, software, database etc.) are protected or likely to be protected by intellectual property rights and/or third parties. The use of any functionality of our Site and more generally its consultation does not carry or imply any authorization or transfer, partial or not, tacit or not, of any nature whatsoever, relating to the Site, its elements of whatever nature it may be, and the rights attached thereto.
The Hotel, the elements it incorporates (including logo, brands) including the works installed there (paintings, photographs, etc.), as well as the content which can be viewed there, are protected or likely to be protected by rights including intellectual property and/or third parties (hereinafter together “the Protected Elements”). The Client's stay at the Hotel does not carry or imply any authorization or transfer, partial or not, tacit or not, of any nature whatsoever, relating to the Protected Elements and the rights attached thereto.
The Client expressly undertakes not to make (and not to allow anyone to make) use in any manner whatsoever of all or part of our Site and/or the Hotel and/or any or part of the elements that they integrate, including the Protected Elements that they include, and in particular any reproduction (including fixation, fixed or animated capture, sound and/or visual), distribution, representation, communication, making available, modification, adaptation , sale, exchange, rental, recording, storage, archiving, and this, by any means or process whatsoever resulting in a violation of rights, whether in particular intellectual property rights, rights of individuals (including the right to the image), and/or any other rights provided for by the regulations in force and/or recognized by case law. A person author or accomplice of all or part of one of these violations may therefore incur civil liability and/or criminal liability, and is thus exposed to all appropriate actions, emanating from Maison Iéna and/or the rights holders. on any of the above elements, and in particular the payment of damages, as well as legal and criminal proceedings.
ARTICLE 7 - PERSONAL DATA
The personal data that Maison Iéna may collect and process in the context of the use of the Site by any person are processed in accordance with the French law of January 6, 1978 as amended and European Regulation No. 2016/679/EU of 27 April 2016 known as “GDPR” and in accordance with the Maison Iéna Privacy Policy at the bottom of the page: https://www.maisoniena.com

Any validation of a reservation on the Site implies acceptance by the Customer of all the conditions for processing their personal data, without restriction or reservation.
Processing of personal data in the event of a reservation made on the Site:
To take into account and process reservations on the site, Maison Iéna necessarily needs the Customer's name, email address, and payment details.
Optionally and only if the Client agrees to provide this additional information, Maison Iéna may also collect the following data in order to be able to contact the Client more easily and/or offer them a more personalized service: first name, telephone number, nationality , and/or any additional information that the Customer would like to provide for the purposes of his or her visit to the Hotel.
The above data is collected and processed as part of the conclusion and execution of the contract between Maison Iéna and the Customer, for the purposes of processing their order and for the purposes of any exchanges that may result therefrom.
Maison Iéna is also likely to use this data as part of the commercial relationship that may arise from exchanges with the Customer, and in the legitimate interest of Maison Iéna to maintain a database of its customers and prospects.
These personal data are intended for the Maison Iéna teams for the exercise of the aforementioned purposes, and where applicable, to its subcontractors. They are kept for the periods necessary for the execution of the aforementioned purposes as specified in the Maison Iéna Privacy Policy at the bottom of the page: https://www.maisoniena.com, and this, within the limit of the limitation periods in force. They may be transferred outside the EU by Maison Iéna subcontractors. Maison Iéna ensures that all of its subcontractors carrying out data transfers outside the EU offer a level of data protection equivalent to that imposed by the GDPR.

ARTICLE 8 - RESPONSIBILITIES
The Customer is solely responsible for his use of the Site, compliance with these General Terms and Conditions and the General Terms and Conditions, applicable standards, current or future, and undertakes to ensure that they are respected by all the people for whom he is responsible (whether either children, incapable adults) and/or by any person intervening on his behalf, and/or by any person present in the room(s) he has reserved, and provides Maison Iéna with all guarantees in this regard.
The Client irrevocably undertakes to guarantee and indemnify Maison Iéna against any recourse, claim or demand from third parties of any nature whatsoever (in particular against any complaint or request emanating from third parties, following the use of the Site, the violation of the T&Cs, CGU or the rights of others or public order, etc.) and undertakes to bear the costs and fees of lawyers and/or advisors relating thereto as well as any convictions, in particular financial damages that could be pronounced against Maison Iéna, without prejudice to any damages that Maison Iéna could claim.
8.1 – Customer behavior in the Hotel:
The Client undertakes to adopt behavior within the areas of the Hotel that is not contrary to laws, regulations, good morals and public order.
The Client acknowledges and accepts that in the event of behavior contrary to the above, Maison Iéna reserves the right to ask the Client to leave the premises without this giving rise to any compensation or reimbursement of the sums paid by the Client. . If he has not already paid the price of all the services he has ordered, the Customer must pay the balance due for this purpose before leaving the premises.
The Client is responsible for any act of vandalism, damage(s), deterioration(s) and destruction(s) and more generally for any damage of any nature whatsoever caused to third parties and/or property in the room(s). s) reserved and/or the other premises of the Hotel or its frontage, which may arise as a result of their stay, and/or as a result of the Client and/or the people for whom they are responsible (whether the children, incapable adults) and/or any person acting on his behalf and/or any person present in the room(s) he has reserved). Consequently, in the event of such damage, the Client undertakes to compensate Maison Iéna for the amount of said damage (and is liable for all the aforementioned persons) without prejudice to any other rights and remedies of Maison Iéna or third parties (such as the rights holders of Protected Elements – see article 6 above) in particular for damages and interest.
8.2 – Personal effects:
Personal effects that the Client and/or any accompanying and/or invited person leave in the Hotel room or in other areas of the Hotel are their entire responsibility. Maison Iéna cannot be held responsible for loss, theft, deterioration or damage caused to said effects.
ARTICLE 9 - FORCE MAJEURE
Neither Party may be held responsible towards the other Party for any failure to perform or any suspension of performance of all or part of its obligations (and the consequences resulting therefrom), resulting from a case force majeure, as this concept is defined by French law and case law, that is to say any event which at the time of the conclusion of the contract was unforeseeable, irresistible and results from circumstances external to the Parties

Applicable law and handling of complaints
These T&Cs are subject to French law. Any dispute relating to the application, interpretation, or execution hereof will be subject to the jurisdiction of the French courts. The Client and Maison Iéna will first endeavor to seek an amicable resolution. To this end, the Customer must first inform Maison Iéna of the subject of their complaint, by registered letter with acknowledgment of receipt to the following address:
